1. Acceptance of Terms

By using this website or requesting a quote or service from Florence-Graham Asphalt Paving, you confirm that you are at least 18 years old, have the authority to enter into an agreement, and agree to be bound by these Terms. These Terms apply to all visitors, customers, and anyone else who accesses our website or engages our services.

2. Description of Services

Florence-Graham Asphalt Paving is a state-licensed asphalt paving contractor based in Florence-Graham, CA. We provide asphalt paving, sealcoating, repair, resurfacing, crack sealing, pothole repair, parking lot maintenance, grading, drainage solutions, and related services to residential and commercial customers in the greater Los Angeles area.

All services are subject to a written agreement or accepted estimate prior to work beginning. We reserve the right to decline any service request at our discretion.

3. Estimates and Pricing

All estimates are based on an on-site evaluation of the project and are provided in writing. Estimates are valid for 30 days from the date of issue unless otherwise stated.

Final pricing may differ from the estimate if the scope of work changes, unforeseen conditions are discovered during the project (such as sub-base failure or drainage issues not visible at the time of estimate), or material costs change significantly between the estimate date and the scheduled work date. We will notify you of any material changes before proceeding.

Estimates provided by phone or online without an on-site visit are approximations only and are not binding quotes.

4. Scheduling and Cancellation

Scheduled work dates are subject to weather conditions, material availability, and crew scheduling. We will notify you as soon as possible if a scheduled date needs to change.

If you need to cancel or reschedule a confirmed appointment, please notify us at least 48 hours in advance. Cancellations made with less than 48 hours notice may be subject to a cancellation fee to cover mobilization costs, as described in your written agreement.

We reserve the right to cancel or reschedule any appointment due to unsafe working conditions, severe weather, or circumstances outside our control without liability.

5. Payment Terms

Payment terms are specified in the written estimate or service agreement. Unless otherwise agreed in writing, payment is due in full upon completion of the work.

For larger projects, we may require a deposit prior to scheduling the work. Deposit requirements will be stated in the written estimate.

Past-due invoices may be subject to interest charges and collection costs as permitted by applicable law. We reserve the right to pursue all available legal remedies for non-payment.

6. Warranty and Service Disclaimers

We stand behind our workmanship. Any warranty applicable to your project will be described in your written agreement. Workmanship warranties are limited to defects caused by our installation methods and do not cover damage from normal wear and tear, vehicle traffic beyond the design capacity of the surface, acts of nature, soil movement, drainage problems that existed prior to our work, or customer modifications to the work after completion.

Material warranties, if any, are subject to the terms of the material manufacturer and are separate from our workmanship warranty.

Except as stated in a written warranty, all services are provided "as is" without additional representations. We make no warranty that any service will achieve a specific outcome beyond what is described in the written agreement.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Florence-Graham Asphalt Paving will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or your use of our website, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to our services will not exceed the amount you paid us for the specific project giving rise to the claim. This limitation applies to all causes of action, whether in contract, tort, or otherwise.

8. Customer Responsibilities

You are responsible for providing accurate information about the property and project, including any known underground utilities, drainage issues, or structural conditions that may affect the work.

You are responsible for ensuring clear access to the work area on the scheduled date, including moving vehicles, equipment, or other obstacles. We may charge for delays caused by inaccessible work areas.

If you are a tenant or property manager, you confirm that you have the authority to authorize the work described in the estimate.

9. Dispute Resolution

If a dispute arises relating to our services, we ask that you contact us directly first so we can try to resolve it. Most concerns can be addressed quickly by phone or email.

If a dispute cannot be resolved informally, the parties agree to attempt mediation before pursuing any legal action. Mediation will take place in Florence-Graham, CA, or at a mutually agreed location.

Nothing in this section prevents either party from seeking emergency injunctive relief or filing a claim in small claims court for eligible disputes.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action arising from these Terms or our services will be brought in the appropriate courts located in California.

11. Website Use

The content on our website is provided for general informational purposes. We make reasonable efforts to keep it accurate and up to date, but we do not warrant that all information is complete, accurate, or current.
